Data Privacy Statement

1. General

We developed the DIALux Mobile app with the goal of providing lighting designers with a tool to enable them to quickly and easily perform standard-compliant lighting calculations with real luminaires on site. This allows lighting designers to directly calculate the luminaire requirements necessary to meet specific requirements.

Like any app, we collect certain information when you use it. In the following, we would like to explain which data we collect and why, and how we evaluate it.

3. Collection of personal data when using our DIALux Mobile app, and the type and purpose of use

(1) When registering to use DIALux Mobile, we will ask you to enter your email address and the industry in which you work. We only use your email address to communicate with you in relation to your registration with DIALux Mobile, or to confirm your identity if you wish to reset your password or delete your account. By providing the industry in which you work, we can conduct statistical surveys on the use of our app and the products used. These statistics are pseudonymised and are not related to you. Additionally, the app allows you to send the results of your planning to your stored email address.

(2) When you use DIALux Mobile, your app will connect to our server. This is where the data is stored and processed. Like most apps, DIALux Mobile generates and stores information that helps us to identify and solve problems in the system, and to keep the app up-to-date for new technologies. We also store this data anonymously. Your IP address is not stored by us. The following information is collected:

(a) Device information
When using the app's search function, we will transfer the pixel ratio of your device so that our server can deliver product images in the resolution appropriate for your device. This pixel ratio is stored in our logs so that we can identify and fix problems that may arise. Additionally, no device information is transferred when using the app.

(b) Server logs
Product search log
The ID of the registered user, the search query, the selected language and system of units, as well as the pixel ratio are saved when searching for products via the app.

Database log
In order to detect data storage related problems, a log is automatically created to record operations that are performing too slowly or that have failed. It is possible that information entered by the user, e.g. email address or password hash value, is stored in the log. The content of this information is not evaluated by us and cannot be systematically evaluated, since operations are not normally logged.

Calculation service log
The calculation service stores the project ID and the information for error analysis purposes.

(3) DIALux Mobile is free of charge. App development and operation are financed by advertising revenues and license fees from manufacturers who offer their products on DIALux Mobile.

To prove the value of a license to these manufacturers, we only collect pseudonymised data on the use of DIALux Mobile and the luminaires used. Pseudonymised means that although we collect information on searches and on the luminaires used, we cannot link this data to your person technically.

We accumulate this information on a monthly basis and provide it to manufacturers who want to obtain an overview of the market. Typical evaluations are:

We evaluate the pseudonymised usage data internally to find out which functions are used and how we can best develop and improve the content of our app. We do not create personalised user profiles.

(4) The initial legal basis for data processing is your consent, pursuant to Art. 6 (1) (1) (a) of the GDPR. In addition, your personal data will be processed on the basis of Art. 6 (1) (1) (b) of the GDPR in order to fulfil the contract on the use of the DIALux Mobile app. Finally, it is processed on the basis of our legitimate interests in accordance with Art. 6 (1) (1) (f) of the GDPR. Our legitimate interest results from the aforementioned purposes for data processing.

4. Disclosure of data to third parties

Your data will not be disclosed to third parties. Your personal data is collected, stored and used solely by DIAL GmbH and service providers who are bound to our instructions and who work for us within the scope of order processing.

5. Your rights

(1) You have the following rights regarding your personal data:

(a) Right of access
You have the right to request confirmation as to whether relevant data will be processed, and to information on this data as well as further details and copies of the data in accordance with Art. 15 of the GDPR.

(b) Right to rectification
In accordance with Art. 16 of the GDPR, you have the right to request the completion of the data or the rectification of the incorrect data concerning you.

(c) Right to erasure or right to restriction of processing
In accordance with Art. 17 of the GDPR, you have the right to request that personal data be deleted immediately, or alternatively the right to request the restriction of processing of the data in accordance with Art. 18 of the GDPR.

(d) Right to data portability
You have the right to receive the data concerning you, which you have provided to us, in accordance with Art. 20 of the GDPR, and to request transmission of this data to other controllers.

(2) You also have the right to submit a complaint to the relevant data protection supervisory authority concerning our processing of your personal data. In our case, this is the North Rhine-Westphalia state official for data privacy and information security (ldi): https://www.ldi.nrw.de/

6. Data security

Your mobile device communicates with our server whenever you use this app. All connections to this system and within the system are encrypted using the generally accepted and secure TLS (Transport Layer Security) standard.

7. Integration of DoubleClick by Google

(1) This app continues to use the online DoubleClick marketing tool by Google. Non-personalised ads are displayed as banners to the user in the app. These banners are filled with pre-made content by DIAL GmbH. Google, therefore, has no influence on the pre-filled ads.

(2) The ad is only in the app's local memory while the app is in use. If the app is closed and reopened, the banner ad is reloaded.

(3) The marketing tools used here allow the app to automatically establish a direct connection to the Google server. We have no influence on the extent and further use of the data collected by Google from the use of this tool. We will inform you according to our state of knowledge. The integrated DoubleClick platform informs Google whenever you access the relevant part of the app or click on an ad from us. If you are registered with a Google service, Google may associate your visit with your account. Even if you are not registered with Google, or have not logged in, the provider may still obtain and store your IP address.

(4) The legal basis for the processing of your data is Art. 6 (1) (1) (f) of the GDPR. 8. Storage period

You can delete your DIALux Mobile account at any time. To do this, please select the "Delete account" function in the app menu. To prevent misuse, we will send you a short email with a confirmation link. Once you click on this link, your account and all the information associated with this account will be deleted. We would like to expressly point out that uninstalling the app from your smartphone does not automatically delete your personal data from our database.
